General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all contracts between Nadine Sommer, Am Giessenpark 15, 8600 Dübendorf, Switzerland (the “Provider” or “we”) and customers (the “Customer”) concerning the purchase of coaching services, digital products, online courses, programmes, webinars and consultations via www.nadinesommer.com or platforms such as Ablefy.

Any differing terms of the Customer do not apply unless expressly agreed in writing.

These GTC apply to consumers and business customers from Switzerland, the European Union and worldwide.

2. Conclusion of Contract

The presentation of products or services on the website does not constitute a legally binding offer, but a non-binding invitation to place an order.

By clicking “Buy”, “Book now” or “Order with obligation to pay”, the Customer submits a binding offer to enter into a contract.

The contract is concluded when the Provider confirms the order by email or via the platform (e.g. Ablefy).

The contract is concluded in German.

Access to digital content is granted after payment has been received.

Any automatic translations of the website or product descriptions are for guidance only and are not legally binding.

3. Prices and Payment Terms

The prices stated at the time of the order apply.

Payment is made using the methods offered (e.g. Stripe, PayPal, credit card, Ablefy).

Prices are stated in Swiss francs (CHF) or euros (EUR), depending on the market.

The purchase price is due immediately upon placing the order.

The Customer may offset counterclaims only if they are undisputed or established by a final and binding court judgment.

Orders from abroad (outside Switzerland and the EU) may incur additional costs due to currency conversion, bank charges or country-specific taxes, which are the Customer’s responsibility.

The payment provider (e.g. Stripe, PayPal) may apply exchange rates or processing fees over which the Provider has no influence.

4. Delivery and Access

Digital products (e.g. e-books, online courses, programmes, videos) are provided electronically via an email link or learning platform after payment has been received.

Coaching appointments are arranged individually via Calendly, email or telephone.

The Provider may adjust the content, dates or procedures of courses and coaching as necessary, provided this does not materially change the overall nature of the offering.

5. Recording of Live Sessions

The Provider may record live sessions, group coaching sessions, webinars and online meetings as part of online programmes and courses.

Recordings are made available exclusively to participants in the respective programme within the protected members’ or course area.

Participation in live sessions is voluntary. Participants may disable their camera and microphone at any time if they do not wish to be actively recorded.

By participating in live sessions, participants consent to recording and its provision within the programme.

There is no entitlement not to be recorded.

6. Right of Withdrawal / Cancellation

For consumers from the EU: The statutory right of withdrawal of 14 days from conclusion of the contract applies. It expires as soon as the Customer expressly agrees that performance (e.g. access to digital content) begins before the withdrawal period expires.

For Switzerland and other countries: There is no statutory right of withdrawal for digital products or services. Cancellation is possible only if expressly agreed in the product description or individually in writing.

7. Licence to Use and Copyright

The Customer receives a non-exclusive, non-transferable right to use the purchased digital content.

Sharing, publication or commercial use of the materials is prohibited without the Provider’s written consent.

All content (texts, videos, PDFs, recipes, designs) is protected by copyright.

8. Health Notice & Disclaimer

Information provided in coaching sessions, courses, programmes, guides, videos and recipes is intended solely for general information and further education.

It does not constitute medical, nutritional medical or psychological advice, diagnosis or treatment.

The Provider is not a physician and makes no promises of a cure.

Consult a physician or other qualified professional before implementing recommendations, dietary changes, supplementation or training programmes, particularly with existing medical conditions, medication use or health complaints.

Dietary supplements are not a substitute for a balanced diet or medical treatment.

Links to external products or providers are provided without warranty. No liability is accepted for their content, quality or legal compliance.

Liability for material or non-material damage arising from use or non-use of the information is excluded to the extent permitted by law.

The Provider excludes all liability to the extent permitted by law, particularly for claims under other legal systems outside Switzerland, Germany or Austria.

9. General Liability

The Provider is liable only for intent and gross negligence.

For slight negligence, the Provider is liable only for breach of essential contractual obligations, limited to foreseeable damage typical of the contract.

Liability for injury to life, limb or health remains unaffected.

No warranty is given for the availability, freedom from errors or technical compatibility of digital systems (e.g. course platform, payment services).

10. Data Protection

Personal data is processed in accordance with the Privacy Policy, which forms part of these GTC.

11. Warranty

Statutory warranty rights apply to digital products.

There is no entitlement to specific results, health improvements or success.

12. Cancellation of Coaching Appointments

Coaching appointments may be rescheduled free of charge up to 24 hours before they begin.

For cancellation at short notice or failure to attend, the Provider may charge the full fee.

13. Jurisdiction and Applicable Law

Swiss law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is Dübendorf, Switzerland, unless mandatory statutory provisions provide otherwise.

For consumers residing in the EU or other countries: The law of the Customer’s habitual residence applies where mandatory consumer protection provisions require it. Otherwise, Swiss law applies exclusively.

The Provider may restrict access to offerings in individual countries where legal or technical requirements make this necessary.

14. Online Dispute Resolution (EU)

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

The Provider is neither obliged nor willing to participate in dispute resolution before a consumer arbitration body.

15. Language & Technical Requirements

All content and contracts are provided in German.

A stable internet connection and suitable device are required to access digital content.

The Provider does not warrant compatibility with specific devices or operating systems.

16. Severability Clause

If any provision of these GTC is invalid or void, the remaining provisions remain valid.

The invalid provision will be replaced by a valid one that comes closest to the original provision’s economic purpose.

You Don’t Have to Do This Alone.

Let’s understand your body better. And find your own way forward.
